TERMS AND CONDITIONS OF USE

Glens Falls Hospital is pleased to provide patients online access to portions of their medical record via a web-based version of our computer system called GFH MyChart. GFH MyChart allows a secure, convenient communications channel for non-urgent messages with your provider. If you believe that you would benefit from this service, you may sign up for access by completing an authorization, and agreeing to these Terms and Conditions.

GFH MyChart may allow you to do the following:

Electronic Messaging

Glens Falls Hospital and its providers will make its best effort to provide a timely response to electronic inquiries. The anticipated turnaround time for response to electronic messages is three (3) business days. If you have an emergency, go to the nearest Emergency Department or dial 911.

With respect to any electronic communications sent by the patient, we are only able to respond to such communications based on the information provided by the patient. If insufficient information is provided, we may not be able to provide accurate and reliable services.

GFH MyChart should never be used for urgent matters!

Access Code

When you enroll in GFH MyChart, you will be provided with a one-time access code. The access code gives you the opportunity to create a personal login name (GFH MyChart ID) and a password. Once the access code is used, it will no longer be valid. Your login name and password are key to protecting the confidentiality of your information. It is your responsibility to prevent disclosure of your login and password, and to change your password if you feel that your security has been compromised. This information is only known by you and not by anyone in the Glens Falls Hospital network. It can be changed online at any time.

GFH MyChart may offer links to related medical websites not managed by Glens Falls Hospital. These links are for informational purposes only. Glens Falls Hospital does not endorse and has not verified the accuracy of the information on these sites, and patients should not rely on any of the information found on the websites for purposes of treatment or diagnosis.

Eligibility of Minors

An individual must be age 18 or older to request a personal account. Parents or guardians of minor children may request access to the minor child’s account by following the terms outlined in the Proxy Access section of the Terms and Conditions statement, as described below.

Proxy Access

Individuals may request proxy access to a minor’s (under the age of 18) GFH MyChart account by completing the GFH MyChart Child Proxy Form and submitting it to the Office Manager at your child’s health center. Such access will only be granted to parties with parental rights or legal guardianship, and only to the extent that the party requesting proxy access can demonstrate the legal right to the minor’s medical information, and only to the extent that the information contained in the GFH MyChart account is not otherwise protected by law. A GFH MyChart account will be activated for both the proxy and the minor account holder.

IF THE PROXY’S LEGAL RELATIONSHIP WITH THE MINOR CHANGES, THE PROXY MUST INFORM THE HEALTH CENTER IMMEDIATELY BY PROVIDING WRITTEN NOTICE TO THE OFFICE MANAGER. GLENS FALLS HOSPITAL RESERVES THE RIGHT TO REVOKE PROXY ACCESS AT ANY TIME FOR ANY REASON.

GLENS FALLS HOSPITAL ACCEPTS NO RESPONSIBILITY FOR THE PROXY’S FAILURE TO NOTIFY IT OF ANY CHANGE OF LEGAL RELATIONSHIP. GLENS FALLS HOSPITAL IS NOT RESPONSIBLE FOR MONITORING THE COURT SYSTEM TO ASCERTAIN ANY CHANGE IN LEGAL RELATIONSHIP BETWEEN THE PROXY AND THE MINOR.

THE PROXY’S ACCESS TO THE MINOR WILL TERMINATE UPON THE MINOR REACHING AGE EIGHTEEN (18).

E-mail Privacy

Patients who are users of GFH MyChart will be notified via e-mail when there is new medical information to be viewed on GFH MyChart. Any person with access to a patient’s e-mail will be able to see the notification. This could include the patient’s spouse, employer or anyone else with access to the patient’s e-mail account. Although no private medical information will be included in the e-mail, there may be information the patient would not want others to know about. Patients should take this into account when providing an e-mail address.

If you send us an e-mail communication, it may be shared with the Glens Falls Hospital staff assisting the physician while providing medical care. A patient’s confidential medical information on GFH MyChart will be accessible only to appropriate clinical staff.

Security and Confidentiality

We afford the same degree of confidentiality to medical information stored on GFH MyChart as is given to medical information stored by Glens Falls Hospital in any other medium. Glens Falls Hospital is committed to protecting the confidentiality of your medical information. We limit Glens Falls Hospital employees’ access and ability to enter or view information based upon their role in your care. Firewalls, passwords, encryption, and audit trails are in place to safeguard your personal information. We shall identify the records released and document the time and date of each access to GFH MyChart.

For other than general information viewing, GFH MyChart must be accessed with a Secure Sockets Layer (SSL) compatible browser or terminal (Internet Explorer, Firefox, Safari, etc). Our SSL web server uses authentication and offers the highest level of encryption technology commercially available (128-bit RC4).

Secure access can be confirmed by looking at the location (URL) field in the web address bar. If the URL begins with https:// (instead of http://), the document source is a secure server. This means your data cannot be read or deciphered by unauthorized individuals.

Appropriate Use

Access to GFH MyChart is granted to users for the purpose of furthering their medical care. Use of the system unrelated to this purpose may result in the deactivation of access privileges. Improper activities include, but are not limited to: the use of inappropriate or abusive language, reserving appointment times that are not needed or are frequently cancelled, inappropriate sharing of passwords, or other activities that cause a disruption to operations.

GLENS FALLS HOSPITAL SHALL NOT BE LIABLE FOR ANY DAMAGES SUFFERED BY THE USER OR OTHER THIRD PARTIES RELATED TO, DIRECTLY OR INDIRECTLY, THE MATERIAL AND INFORMATION CONTAINED IN GFH MYCHART. IN NO CIRCUMSTANCES WILL GLENS FALLS HOSPITAL BE LIABLE TO THE USER OR ANY OTHER PERSON FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY TYPE, EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. GLENS FALLS HOSPITAL CANNOT GUARANTEE ACCESS TO THE GFH MYCHART SYSTEM AND IS NOT LIABLE FOR THE USER’S INABILITY TO ACCESS OR VIEW INFORMATION ON THE SITE. BY DOWNLOADING OR VIEWING INFORMATION ON GFH MYCHART, THE USER AGREES TO HOLD GLENS FALLS HOSPITAL HARMLESS AND INDEMNIFY IT AGAINST ANY DAMAGES, CLAIMS, OR OTHER CLAIMS ASSERTED AGAINST GLENS FALLS HOSPITAL ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, THE USER’S UTILIZATION OF GFH MYCHART OR THE INFORMATION CONTAINED THEREIN.

By accessing or using GFH MyChart you agree to be bound by all the Terms and Conditions as noted above. You can terminate your use of GFH MyChart at any time by completing the appropriate online request to cancel your account or by calling your health center’s Office Manager.
